The application is reserved exclusively for Authorized Users.LightX Innovations Inc. (“LightX”) does not make the application available to others; you should not download or use it if you are not an Authorized User.
Any Authorized User who decides to download and/or use the application must carefully read these conditions as well as any other applicable conditions. Any person downloading and/or using the application is deemed to fully adhere to them.
LightX may, at its sole discretion, modify, suspend, restrict access, or terminate to the application. To the extent permitted by applicable law, these changes will take effect as soon as they are made available.
Authorized Users must at all times respect applicable privacy laws, as well as their legal, professional and ethical obligations, in particular those relating to confidentiality, patient consent, and the retention of medical data.Lightx emphasizes that the use of the application must be made after taking due account of these obligations.
If LightX believes (or is aware) that an Authorized User is violating these terms or any other applicable terms, or is in violation of the law, LightX reserves the right to limit, restrict, suspend, or revoke their rights to access and/or use the application, and to take any other measures provided for by law.
Although LightX makes reasonable efforts to ensure that the application functions properly according to its specifications, it notes that the application is not infallible And that she has no control on the quality or characteristics of the photos or information uploaded. Consequently, LightX expressly states that:
i. the application is provided “as is” and “as available” ;
ii. like any technology, it is not entirely immune to cyberattacks or unpredictable events;

LightX disclaims any warranty, statement, or condition, written, oral, express or implied, in particular with respect to merchantability, fitness for a particular purpose, the absence of defects, errors or inaccuracies, continuous availability, updating, or the absence of infringement of third party rights.
If the application proves to be defective, LightX reserves the right to partially or completely interrupt access to it or certain functionalities.
Although the application automatically processes and analyzes certain information relating to the health or medical condition of patients, It does not provide medical advice.It only constitutes a help tool for Authorized Users and Do not have to :
i. be used for self-diagnosis;
ii. be interpreted as an assessment of a medical condition;
iii. be considered to provide a prognosis, opinion, diagnosis, definitive statement, or medical recommendation;
iv. be used as a substitute for professional advice.
Authorized Users remain fully responsible of their own assessment and the decisions, guidelines, or conclusions they make.lightx does not recommend or endorse any treatment, product, process, or service.Finally, the information provided by the application should be interpreted and adapted by Authorized Users, in accordance with local standards and current health care policies.
Authorized Users acknowledge and agree that:
i. the access and use of the application take place for legitimate purposes, on their own initiative and in accordance with their ethical obligations;
ii. the application is the LightX property and may be protected by patents or other intellectual property rights;
iii. they access and use the application at their own risk.
These essential conditions apply in addition to any other conditions of an application store, and prevail in case of inconsistency.
Access, use and any dispute related to the application are governed by the laws in force in the province of Quebec, excluding conflict of law principles, and subject to the exclusive jurisdiction of the courts of Quebec, unless there is a public policy to the contrary.
Authorized Users assume all costs associated with the maintenance, repair, or correction of their own electronic devices.
Copyright notices and other proprietary notices cannot be removed or concealed.The application may not be used for purposes other than those expressly authorized by lightX.elle cannot be modified, distributed, combined, disassembled, decompiled nor be the subject of a reverse engineering or any other manipulation.
To the extent permitted by law:
i. LightX does not assume no responsibility for any damage or claim arising from the situations described in these conditions;
ii. LightX cannot be held responsible for indirect, incidental, or consequential damages, including the loss of data, opportunities, reputation, reputation, profits, or revenue associated with the application.
This limitation of liability is an integral part of the agreement between any user and LightX and applies to all claims, even if LightX has been advised of the possibility of such damages.
